TERMS OF USE

Welcome to Kartiya. These Terms of Use ("Terms") form a binding agreement between you and the developer of the Kartiya mobile application and related services ("Kartiya", "we", "us", or "our"). By downloading, installing, or using Kartiya, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.

1. FOR ENTERTAINMENT ONLY

Kartiya is a tarot and divination app made for entertainment, reflection, and personal enjoyment. The readings, card interpretations, and any text generated in the app are not statements of fact and are not professional advice of any kind.

Kartiya does not provide medical, psychological, legal, financial, relationship, or any other professional advice. Nothing in the app is a substitute for consultation with a qualified professional. You should never disregard professional advice, or delay seeking it, because of something you read in Kartiya.

You are solely responsible for any decision you make or action you take based on the app. If you are in crisis, or may be a danger to yourself or others, contact your local emergency services or a qualified professional immediately.

2. WHO MAY USE KARTIYA

You must be at least 18 years old, or the age of majority where you live, to use Kartiya. By using the app, you confirm that you meet this requirement. Kartiya is not directed to children, and we do not knowingly permit use by anyone under that age.

3. YOUR ACCOUNT AND YOUR READINGS

You can use Kartiya without an account. If you create one, to save and sync your readings across devices, you must provide an accurate email address, keep your password confidential, and accept responsibility for activity under your account. You may delete your account at any time from within the app, or by contacting us, and we may suspend or close an account that violates these Terms.

When you request a reading, you may type a question and choose a spread. Your question, the cards drawn, and related details are sent to our servers and processed (including by third-party artificial-intelligence providers) to generate a reading.

You are responsible for what you submit. Please do not enter another person's sensitive personal information, or any unlawful, abusive, or infringing content. Do not rely on the app to store information you cannot afford to lose.

You keep any rights you have in the questions you write. You grant us a limited licence to use, store, and process that content for the purpose of operating the app, generating and saving your readings, and keeping the service secure. How we handle this content is described in our Privacy Policy.

4. AI-GENERATED CONTENT

Readings are produced with the help of automated systems and large language models. This content is generated, may be inaccurate, inconsistent, or unexpected, and is provided for entertainment only. We do not guarantee that any reading is accurate, complete, or suitable for any purpose.

5. FREE READINGS, KARTIYA PLUS, AND BILLING

Kartiya offers a limited number of free readings each day. Kartiya Plus is an optional paid subscription that unlocks additional features, such as unlimited readings, the full deck, additional spreads, follow-up questions, and an extended reading journal.

• Subscriptions are sold and billed through the Apple App Store or Google Play, under that store's terms, using the account you hold with that store.
• Subscriptions renew automatically for the same period, at the then-current price, unless you cancel at least 24 hours before the end of the current period.
• Your store account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel a subscription at any time in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• Prices and the features included may change. Where required by law or store rules, we will give notice and, where applicable, ask for your consent before a change takes effect.
• Payments are handled by the stores. Refunds, where available, are governed by the policies of the App Store or Google Play. We generally cannot grant refunds directly.

Any prices, free-tier limits, and feature lists shown in the app are part of these Terms while they are displayed, and may be updated.

6. ACCEPTABLE USE

You agree not to: use the app for any unlawful purpose; attempt to access, probe, or disrupt our servers or other users' data; reverse engineer, decompile, or tamper with the app except where the law expressly allows it; resell or commercially exploit the app or readings without our permission; or use automated means to access the service in a way that burdens our systems.

7. INTELLECTUAL PROPERTY AND CREDITS

The Kartiya app, its name, design, text, and original artwork are owned by us or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use.

Some assets are used under their own licences, with thanks: certain interface icons from game-icons.net (CC BY 3.0); the tarot card images, being the original 1909 Rider-Waite-Smith deck drawn by Pamela Colman Smith, now in the public domain; and public-domain paintings, including "The Crystal Ball" by John William Waterhouse (1902). These remain the property of their respective creators or of the public domain.

8. DISCLAIMERS

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that readings will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the app or any reading. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 20. Nothing in these Terms limits liability that cannot be limited by law.

10. INDEMNITY

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the app, your content, or your breach of these Terms.

11. CHANGES, SUSPENSION, AND TERMINATION

We may update, suspend, or discontinue the app or any feature at any time. We may suspend or end your access if you breach these Terms. You may stop using the app at any time. Provisions that by their nature should survive (including the content licence, disclaimers, limitation of liability, and indemnity) survive termination.

12. CHANGES TO THESE TERMS

We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you in the app. Your continued use after the changes take effect means you accept the updated Terms.

13. GOVERNING LAW

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live.

14. APP STORE TERMS

You obtained Kartiya from a third-party app store ("Store"), and your use is also subject to that Store's terms.

• This agreement is between you and us only, not with the Store, and the Store is not responsible for the app or its content.
• The Store has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify the Store, and (for Apple) the Store may refund the purchase price; to the maximum extent permitted by law, the Store has no other warranty obligation.
• The Store is not responsible for addressing any claims relating to the app, including product-liability, regulatory, or intellectual-property claims.
• When you obtain the app from the Apple App Store, Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
